Some gavers have filed a lawsuit over custom duty refunds against Nintendo

After being struck down by the Supreme Court last February, the U.S. customs duties imposed by President Donald Trump had led to price increases on various products. Since the ruling, companies have been able to claim refunds through a dedicated portal.

Nintendo is among the companies that have decided to recover the amount related to the unfairly applied tariffs. However, some gamers have decided to file a class-action lawsuit against the Japanese firm. The plaintiffs, Gregory Hoffert (California) and Prashant Sharan (Washington), argue that Nintendo will collect the same customs duties twice. Once by raising prices for consumers and a second time by obtaining the aforementioned refund. An unfair situation for the two gamers.

“Unless restrained by this Court, Nintendo stands to recover the same tariff payments twice—once from consumers through higher prices and again from the federal government through tariff refunds, including interest paid by the government on those funds.”

The plaintiffs also argue that “Nintendo’s recovery of any customs duty refunds would constitute unjust enrichment and violate Washington State’s consumer protection law.”

The lawsuit applies only to consumers residing in the U.S. who were subject to the price increase on Nintendo products between February 1, 2025, and February 24, 2026.
